    A furious driver who brought a class action lawsuit against Toyota over a ‘dud’ car has had a major win in the ongoing legal stoush.

    Ken Williams took his fight to the federal court claiming his Prado’s oil system was faulty and that the ‘defect’ is also in about 320,000 other Toyota SUV models built between 2015 to 2019.

    Now, an expert referee has vindicated the furious driver’s accusation in a report adopted by the court which outlines Prado, HiLux and Fortuner models built during much of that time do not function effectively.

    ‘This independent report shows what I have been saying all along, that my car is not fit for purpose,’ Mr Williams told the Daily Telegraph.

    ‘I believe Toyota sold me and hundreds of thousands of other Aussie families a complete dud.’

    Mr Williams claims his vehicle’s Diesel Particulate Filter (DPF) system became blocked over time.

    ‘This, in turn, causes the affected vehicles to experience a myriad of other issues, including decreased power, increased fuel consumption and the emission of excessive white smoke and diesel particulate matter into the atmosphere,’ Bannister Law Class Actions and Gilbert and Tobin Lawyers said on the class action website.

    ‘The affected vehicles experiencing these issues require time consuming and costly repairs, including repeated vehicle servicing and repeated replacement of the DPF in its entirety.’

    But the car manufacturing giant said in a statement that Toyota has implemented a number of ‘technical remedies’ to fix the problem.

    ‘Toyota has worked tirelessly and transparently since becoming aware of concerns to find the best resolution for our customers – we are confident that the most recent countermeasure will remedy the DPF issue,’ a spokesperson said.

    ‘Field fixes’ have been provided without charge for affected vehicles and warranties have been extended to 10 years regardless of mileage.

    Toyota said they are continuing to investigate the issue but deny the vehicles are defective.

    However the referees’ report by former General Motors’ emissions chief David Garrett concluded the DPF system ‘was not designed to function effectively during all reasonably expected conditions of normal operation and use (in Australia)’.

    It is estimated about 100,000 Toyota vehicles are affected in New South Wales, a further 100,000 in Queensland, approximately 50,000 in Victoria and over 20,000 in South Australia.

    Every owner who purchased an affected vehicle is automatically included in the class action.

    The class action is seeking compensation for losses and damages, reduced vehicle valuations, increased fuel consumption, as well as servicing and repair costs.
